AKSARALOKA.COM, PONTIANAK-Dituding menyerobot tanah warga seluas 111 hektare di Desa seberang Kapuas Kecamatan Sekadau Hilir, PT. APL membantah keras hal tersebut. Bantahan tersebut disampaikan langsung oleh kuasa hukumnya, Herman Hofi Munawar, Sabtu 14 Januari 2023 di Pontianak.
Tudingan tersebut dianggap tak berdasarkan, lantaran PT. APL mengklaim mengantongi Sertifikat Hak Guna Usaha nomor 17 dan 19. Tak hanya itu, PT. APL juga memastikan menggugat Rudy dengan tuduhan melakukan perbuatan melawan hukum di Pengadilan Negeri Sanggau.
Menurut Herman Hofi Munawar, dua SHGU yang dimiliki PT. APL bukanlah barang jatuh dari langit. Melainkan melewati proses mulai dari pemilik lahan, pemerintah desa, instansi pemerintahan hingga akhirnya keluar SK dan SHGU.
“Perusahaan sawit yang berlokasi di Kabupaten Sekadau ini memiliki legalitas yang jelas,” tegas Herman Hofi.
Lanjut Herman Hofi, PT. APL telah beroperasi sejak 2006. Di mana saat itu hingga sekarang tidak ada masalah. “Tidak ada satu pun yang komplain dengan lahan tersebut. Karena hak masyarakat pemilik plasma juga diberikan,” ujar Herman.
Dikatakan Herman Hofi, persoalan ini muncul di tahun 2021, yakni berawal dari PT. APL hendak mendirikan pabrik kelapa sawit. Rencana itu pun disambut baik masyarakat. “Masyarakat ingin dibangun pabrik didekat lingkungan masyarakat agar mendapat kemudahan kerja. Akhirnya, PT. APL membangun sesuai tempat yang diinginkan masyarakat,”kata Herman.
“Akhirnya terjadilah land clearing. Sawit yang sudah ditanam ditebang untuk pembangunan pabrik,” sambungnya.
Namun ditengah jalan, dibeberkan Herman, terjadi gangguan, di mana bentuk gangguan itu dilakukan seseorang bernama Rudy dengan klaim bahwa lahan ini milik orang tuanya. “Dia ngomong kesana kemari lahan ini milik orang tua dan sebagainya,” ujar Herman.
Tak cukup disitu, Rudy juga melaporkan PT. APL ke Kejaksaan Negeri Sanggau dengan tuduhan mafia tanah. “Laporan Rudy mental. Tudingan Rudy dianggap tak terbukti. Namun Rudy tak berhenti disitu. Ia kembali membuat laporan polisi ke Polres Sekadau,” sambungnya.
Herman berpendapat, kasus tersebut stagnan, karena legalitas pihak yang mengklaim tanah tersebut tidak jelas. Berbeda dengan perusahaan yang punya legal standing yang kuat. “Walau Rudy punya sertifikat, tapi sertifikat yang dimiliki tak jelas. Salah satu kejanggalannya tanah itu, tak memiliki warkah tanah. Hal tersebut pun sudah dikonfirmasi ke BPN Sanggau,”tegasnya lagi.
Warkah tanah mengandung dua unsur. Yakni : yuridis dan historisnya. “Dia punya cerita tanah ini didapat dari mana? Sampai saat sekarang tidak ada itu. Untuk itu, tak ada persoalan sengketa lahan, kami anggap tidak ada. Yang ada hanya gangguan,” sambungnya lagi.
Karena tak kuasa berpolemik, PT. APL mengalah. Titik pembangunan pabrik digeser. Akhirnya lahan terbengkalai. Penggeseran ini dilakukan setelah jalur mediasi yang ditempuh tak ada titik temu. Karena itulah, perusahaan melakukan gugatan perbuatan melawan hukum. “Sebab, perusahaan mengalami kerugian material atas perbuatan melawan hukum tersebut,” ucap Herman
“Perbuatan melawan hukum tersebut ada unsur kerugian. Untuk itulah, perusahaan minta ganti rugi sebesar Rp84, miliar lebih,” cecar Herman.
Selain itu, perusahaan memastikan akan menempuh jalur hukum yang lain, perusahaan juga akan menempuh jalur pidana.
Sementara itu, GM PT. APL, Yosafat menyebut, lahan seluas 106 hektare yang diklaim milik Rudy telah diserahkan Aliang paman Rudy ke PT. APL tahun 2006.
Yosafat menceritakan bahwa pada tahun 2006 lalu, Aliang mengajukan permohonan kepada PT. APL untuk mengikuti program kemitraan. Kemudian dilakukanlah survey dan pengukuran pada lahan secara bersama sama saksi Nyangku.
Hasil pengukuran diperoleh luas 106 hektare. Selanjutnya saudara Aliang menandatangani surat pernyataan penyerahan lahan untuk dijadikan mitra. “Setelah menyerahkan lahan, Aliang memperoleh hak-nya berupa tanah 16 kapling. Jadi dia serahkan 100 hak-nya dia mendapatkan hak 16 kapling,” kata Yosafat.
Yosafat juga memastikan, bukti penyerahan lahan tersebut dimiliki perusahaan. (Zrn)
