AKSARALOKA.COM, SEKADAU-PT. Agro Plankan Lestari (APL) dilaporkan ke Polres Sekadau, lantaran diduga melakukan penyerobotan lahan milik warga seluas 111 hektar. Tepat lokasi dugaan penyerobotan itu terletak di Desa Seberang Kapuas, Kecamatan Sekadau Hilir Kabupaten Sekadau.
Melalui kuasa hukumnya dari Firma Hukum Herawan Utoro, menyampaikan pengaduan atas dugaan penyerobotan tanah tersebut telah diserahkan ke Polres Sekadau pada 23 Agustus 2022 lalu atas dugaan penyerobotan tanah milik Rudy oleh PT. APL sejak 2006 lalu.
“Tanah seluas 111 hektar di Desa Seberang Kapuas, Kecamatan Sekadau Hilir milik klien kami atas nama Rudy, memiliki bukti-bukti kuat kepemilikan berupa beberapa sertifikat hak milik yang diterbitkan lebih dahulu yakni kurang lebih 45 tahun yang lalu oleh Kantor Pertanahan Kabupaten Sanggau yang terdaftar atas nama ibunya, pamannya, bibinya, pihak ketiga lainnya yang telah diserahkan dan dikuasakan secara notarial kepada klien kami,” jelas Fransiskus salah satu pengacara dari Firma Hukum Herawan Utoro, belum lama ini.
Adapun bukti-bukti penguasaan atas tanah tersebut yang ada pada kliennya, dikatakan Fransiskus , bahwa yang diketahui dan atau diregister oleh Kades Seberang Kapuas daripada Sertipikat Hak Guna Usaha (SHGU) Nomor : 17 dan SHGU Nomor : 19 masing-masing dari keduanya tertanggal 22 Januari 2009 dan terdaftar atas nama PT. AGPL yang baru diterbitkan setelah dibentuknya Kabupaten Sekadau.
“Bukti-bukti surat berupa lima buku SHM dan saksi-saksi telah diserahkan dan dihadirkan klien kami ke penyidik Polres Sekadau,” ujar Fransiskus.
Fransiskus menegaskan, bahwa terhadap penyelidikan atas pengaduan kliennya itu, tentunya penyidik sudah memintai keterangan kepada PT. APL.
“SHGU Nomor 17 dan SHGU nomor 19 masing-masing dari keduanya tertanggal 22 Januari 2009 dan terdaftar atas nama PT. APL tersebut diterbitkan diatas tanah milik kliennya, diserahkan dan dikuasakan dengan luas 111 hektar,” tegas Frans.
Diterangkan Frans, atas pengaduan tersebut, diduga kedua SHGU atas nama PT. APL diduga telah dibuat secara palsu atau dipalsukan, tidak sesuai dan atau bertentangan dengan kenyataan yang sebenarnya.
“Dugaan kedua SHGU tersebut palsu atau dipalsukan dikarenakan riwayat perolehan, penguasaan, pemilikan tanah dari Aliang yang menyerahkan tanah kepada PT. APL mengandung pemalsuan, alas hak, batas-batas tanah dan saksi-saksi dari penyerahan lahan dan serah terima lahan dari Aliang kepada PT. APL adalah tidak jelas dan atau tidak ada,” bebernya.
Dugaan kedua SHGU itu palsu, karena surat permohonan sebagai peserta program kemitraan yang diajukan oleh Aliang kepada PT. APL, penyerahan lahan, survey dan pengukuran lahan dan serah terima lahan dari Aliang kepada PT. APL, dilakukan pada tanggal yang sama yakni tanggal 19 Agustus 2006 atau hanya satu hari.
“Sedangkan luas lahan adalah kurang lebih 106,034 hektar. Sehingga bertentangan dengan akal sehat. Kemudian nama T. Betung dan Sungai yang menjadi saksi penyerahan dan serah terima lahan antara Aliang dengan PT. APL tidak terdaftar dalam data kependudukan warga desa atau dusun dan tidak pernah ada nama kedua orang tersebut,” ucapnya.
Fransiskus menyatakan, terhadap penyelidikan atas pengaduan kliennya tersebut PT. APL khawatir terjadi pengembangan penyidikan dan penuntutan dengan obyek delik pemalsuan surat yang menjadi dasar diterbitkannya kedua SHGU tersebut. Sehingga kemudian pihak perusahaan mengajukan gugatan perkara ke Pengadilan Negeri Sanggau sebagai upaya agar polisi menangguhkan penyidikan dan penuntutan atas pengaduan yang diajukan kliennya.
“Pada Rabu 11 Januari 2023, klien kami telah mengajukan keberatan terhadap penerbitan kedua SHGU tersebut ke Kantor Pertanahan Kabupaten Sekadau,” terang Fransiskus.
Sementara itu, Kasat Reskrim Polres Sekadau, Iptu Rahmad Kartono, membenarkan, jika pihaknya telah menerima pengaduan dugaan penyerobotan lahan yang diadukan pemilik tanah atas nama Rudy. “Pengaduan tersebut saat ini masih dalam proses penyelidikan,” kata Rahmad, ketika via pesan whatsapp.
Rahmad menjelaskan, dari penyelidikan tersebut pihaknya sudah memberikan surat pemberitahuan perkembangan hasil penyelidikan kepada pengadu. “Kami telah memeriksa sekitar 11 orang saksi dan telah melakukan pengecekan lokasi letak tanah,” tuntas Rahmad. (Zrn)
